Terms and conditions applicable to buying products from the Ordnance Survey leisure map shop

Purchasing products online with Ordnance Survey

1 Terms

1.1     These terms apply to all products purchased by consumers from our website for their personal, non‑commercial use. Separate terms apply to any purchases made by our business customers. These terms do not affect your legal rights.

1.2     We may change these terms at any time, provided that any such change will not affect any orders you have placed before the change is implemented. The terms currently in effect are those published on this website.

2 Orders

2.1     The ordnancesurvey.co.uk website (the ‘Website’) is owned and operated by Ordnance Survey. All of the goods on this Website are offered by Ordnance Survey (‘we/us’) which will be the contracting party for any order that you place.

2.2     Please see the help pages for information on how to place an order. You will have an opportunity to check, amend the details and correct any input errors in your order up until the point at which you submit your order by clicking the ‘place order’ button on the checkout page.

2.3     All orders are subject to acceptance and availability.

2.4     Acceptance: When you place an order to purchase a product from us, we will send you an email, to the email address you provide at the time you place your order, confirming receipt and containing details of your order. However, this will not bring into existence a legally binding contract between us. Your order represents an offer to us to purchase a product which is accepted by us when we send email confirmation to you that we have dispatched the product to you. Any products on the same order which we have not confirmed in an email to you as being dispatched do not form part of that contract. We may choose not to accept your order for any reason and will not be liable to you or to anyone else in those circumstances.

2.5     Availability: We endeavour to ensure that all our titles in print are available all the time. Occasionally, a product may be out of stock due to a reprint or revision or it may be yet to be released. If a product is temporarily out of stock, we will advise you of this as soon as possible after receipt of your order. You will have the option of either waiting until the item is available from stock or cancelling your order. If a product is yet to be released, this information will be shown on the Website together with the expected release date.

3 Prices and Promotions

3.1     All prices and charges on the Website are shown in UK pounds sterling. They include any VAT payable but exclude delivery charges (see section Delivery and Charges). We are not responsible for any other importation taxes, sales taxes or charges that may be levied at the delivery destination.

3.2     On occasion, the prices payable and promotions offered in respect of products advertised on the Website may differ from the prices and promotions offered by: (i) those retail stores and outlets which stock our products, and/or (ii) third party websites which offer our products to customers online. We are under no obligation to honour any in-store price or promotion in the event that they differ from those on the Website. Similarly, Ordnance Survey is under no obligation, in any Ordnance Survey outlets, to honour any Website price or promotion in the event that they differ from those offered by any of our outlets.

3.3     On occasion we may offer price reductions and promotions on the Website and/or offline promotional codes for use in conjunction with Website ordering. Prices that are reduced for sales and promotions and promotional codes that are issued offline for use in conjunction with Website ordering are only valid for the specified period.

3.4     We reserve the right to adjust prices, offers, goods and specifications of goods on the Website at our discretion at any time before (but not after) we accept your order.

4 Delivery and Charges

4.1     Delivery will be made as soon as possible after your order is accepted. We will deliver all products comprised in your order in one delivery. Where all products on your order are in stock we will endeavour to dispatch your order within six (6) working days. However, where any of the products on your order are not in stock at the time you place your order, we will wait until they come back into stock or are released (as the case may be) before arranging dispatch of your order.

4.2     If your order remains undelivered thirty (30) days after it was received, you should contact us by telephone or email and confirm whether you wish to continue with the order or cancel it. If you choose to cancel your order, in the absence of negligence on our part, we will not be obliged to offer any compensation for disappointment suffered.

4.3     You may however cancel your order for any item which is temporarily out of stock or yet to be released at any point prior to the estimated delivery date. This is in addition to any rights you may have to cancel your order or return the products once they have been delivered.

4.4     Products are dispatched by the Royal Mail or, for certain products where indicated on the Website, by courier service and for UK deliveries will usually arrive the next working day after dispatch. Overseas orders will take approximately ten (10) working days. We regret that we are unable to supply courier‑delivered products other than to an address within the United Kingdom (excluding the Channel Islands). We will deliver the products ordered by you to the address you give us for delivery at the time you make your order. Courier deliveries must be signed for and are made Monday to Friday (excluding bank and public holidays), normally between the hours of 8 am and 5 pm. The precise timing of a delivery cannot be specified.

4.5     You will become the owner of the products you have ordered when they are delivered to you, provided we have received payment in full. Once the products have been delivered to you they will be your responsibility and, except in relation to products that are damaged, defective or incorrectly delivered, we will not be liable for damage, loss or destruction after they have been delivered.

4.6     Delivery charges are as set out in the Delivery Rates section of the help pages, and will be automatically calculated and added to your order before you submit it on the checkout page. Delivery charges will also be confirmed on the order confirmation.

4.7     From time to time, we may reduce or even remove delivery charges as part of a promotion or other activity. Again, if the charges are reduced, the amount will be clearly indicated on the order and on the order confirmation.

5 Payment

5.1     Payment can be made by most major credit or debit cards by completing the relevant details on the checkout page. Payment will be debited from your account upon placing of your order. However, the fact that payment has been debited will not bring into existence a legally binding contract between us until your order has been accepted (see section Orders). If your order is not accepted for any reason, any sum debited by Ordnance Survey from your credit or debit card account will be credited back to your account, in full, as soon as possible.

5.2     You confirm that the credit/debit card that is being used is yours. All credit/debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your card refuses to authorise payment we will not accept your order and we will not be liable for non-delivery and are not obliged to inform you of the reason for the refusal.

5.3     We are not responsible for your card issuer or bank charging you as a result of our processing of your credit/debit card payment in accordance with your order.

6 Cancelling an Order and Product Returns

Cancellation by us:

6.1     Although we endeavour to ensure that all pricing information on our Website is accurate, occasionally an error may occur and products may be mispriced. If we discover a pricing error before we confirm the products have been dispatched to you, we will, at our discretion, either contact you by telephone or email and ask you whether you wish to continue with the order at the correct price or notify you that we have cancelled your order. Unless we have already confirmed dispatch of the products, we will not be obliged to supply products at the incorrect price.

6.2     If we cancel your order for any reason, any sum debited by Ordnance Survey from your credit or debit card account will be credited back to your account, in full, as soon as possible.

Cancellation by you:

6.3     Except in relation to the products set out in Clause 6.9 below, once you have placed an order with us, you may cancel your order at any time within thirty (30) days starting on the day upon which you receive the products. You do not need to give Ordnance Survey any reason for cancelling your order, but a brief explanation will help us to improve the service we offer to customers in the future.

Cancellations before you have received the products:

6.4     To cancel your order before you have received the products, you should notify us by contacting our Customer Service Centre (see section Contact us), giving us your full name, address and order reference number.

6.5     Once you have notified Ordnance Survey that you are cancelling your order, any sum debited by Ordnance Survey from your credit or debit card account will be credited back to your account, in full, as soon as possible. Alternatively, you may ask us to substitute a product, rather than provide you with a refund, but we can only do that if the product you wish to substitute is of equivalent value to the order you are cancelling.

Cancellations after you have received the products:

6.6     This policy in relation to cancellations after you have received the products does not apply to products which are damaged, defective or incorrectly delivered (see section Damaged, defective, incorrectly or non-delivered products)

6.7     To cancel your order after you have received the products, you should notify us by contacting our Customer Service Centre (see section Contact us), giving us your full name, address and order reference number and, if you are contacting us in writing, by fax or by email, a contact telephone number at which we may call you back so that we may advise you of the returns address and a returns number.

6.8     You must return the products to us at the returns address, and by the returns method, supplied to you by our Customer Service Centre marked with your allocated returns number. Products are returned at your own risk of loss or damage, so you should wrap them securely and take out enough postal insurance to cover their value. We will not be liable for any costs you incur by choosing to return products by a method other than the one supplied to you by the Customer Service Centre.

6.9     However, you cannot cancel your order if: 1) you have taken any audio and/or visual recordings or computer software out of the sealed package in which they were delivered to you or 2) the products ordered by you are customised or made to your personal specifications (including OS Select maps and Historical Mapping products). Such orders may not be cancelled and the products may not be returned unless damaged, defective or incorrectly delivered (see section Damaged, defective, incorrectly or non-delivered products).

6.10   Once you have notified Ordnance Survey that you are cancelling your order, subject to Clause 6.13, we will refund any money received from you for the products together with the original delivery charges as soon as possible, but you will be responsible for the cost of returning the products. Alternatively, you may ask us to substitute a product, rather than provide you with a refund, but we can only do that if the product you wish to substitute is of equivalent value to the order you are cancelling.

6.11   Where you cancel an order after we have dispatched the products, you will be under a duty to return the products to us in their original condition. Until such time as the products are returned to us, you are under a duty to retain possession of the products and to take reasonable care of them. If you fail to take reasonable care of the products before they are returned to us and this results in damage or deterioration, we will be entitled to charge you for the reduction in value by deducting it from the amount to be re-credited to you.

6.12   If you do not return the products delivered to you we will be entitled to deduct the direct costs of collecting the products from you from the amount to be re-credited to you.

6.13 Where you cancel an order relating to products which have been purchased using a promotional offer, we will refund the purchase price less the value of any promotional offer amount and applicable charges.

By way of example:

(a) The promotional offer is ‘Spend over £25 and receive £5 off’ .You order two items, one at £20.00 and one at £28.00, meaning you pay £43.00 exc p&p. You return the item costing £28.00 which reduces the total value of the order to £20.00. In this case, the refund (£28.00) on the returned item is reduced by the value of the promotional offer (£5.00) and you receive a refund of £23.00 exc p&p.

(b) The promotion is a 3 for 2 offer – ‘buy 3 maps, pay for 2’. The standard price for each map is £7.99. You order three maps, meaning you pay £15.98 exc p&p. If you return one map, reducing the number of maps purchased to two, the refund (£7.99) on the returned map is reduced by the value of the promotional offer (one free map at £7.99), so you receive no refund. If you return two maps, the refund (£15.98) is reduced by the value of the promotional offer (£7.99) and you receive a refund of £7.99.

7 Damaged, defective, incorrectly or non-delivered products

7.1     If the products we deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, you should notify us of the problem within ten (10) working days of the delivery of the products in question by contacting our Customer Service Centre (see section Contact us), giving us your full name, address and order reference number and, if you are contacting us in writing, by fax or by email, a contact telephone number at which we may call you back so that we may advise you of the returns address and a returns number.

7.2     You must return damaged, defective or incorrect products to us at the returns address, and by the returns method, supplied to you by our Customer Service Centre marked with your allocated returns number. Failure to do so may delay the repair, replacement or refund of your order. Please wrap the products securely.

7.3     If you do not receive products ordered by you within thirty (30) days of the date on which you ordered them, you should notify us by contacting our Customer Service Centre (see section Contact us), giving us your full name, address and order reference number.

7.4     Nothing in this policy on damaged, defective, incorrectly or non-delivered products affects your legal rights.

8 Personal information

When you place an order, we collect personal information as part of the online customer registration process, including your name, address, contact details and payment card details. This information will be held by Ordnance Survey, or by our authorised agents, and used to process and fulfil your order and to corroborate your identity. The personal information you have provided will be held so that you will not need to re-enter these details next time you place an order, but can re-call them by entering the username and password which you will be prompted to create when you first register as a customer. When you place an order using a credit or debit card, we will carry out security checks to protect against fraudulent transactions.

9 Security

9.1     We understand that you may have concerns about security on the internet. Our Website uses a secure server that implements secure sockets layer (SSL) technology in our online ordering process to protect your payment card information.

9.2     Once you have completed the selection of products you wish to purchase you may proceed to place an order. As soon as you click ‘checkout’, your browser will go into secure mode. Data relating to your order and your personal and payment card details will all pass to our server in an encrypted format. As soon as you have finished ordering you will exit secure mode. As an additional protection for you, our system is designed so that you cannot place an order until you are safely within secure mode.

9.3     We recommend that you do not communicate your payment card details to anyone, including us, by email. We cannot be responsible for any losses you may incur in transmitting information to us by internet link or by email. Any such loss will not be borne either wholly or partly by us, and will be entirely your responsibility.

9.4     If you have any additional queries about security, please email us at customerservices@ordnancesurvey.co.uk
